    Get your hands off those cellphones, Ontario drivers -- a new law that bans using hand-held devices to talk, email, or send text messages while behind the wheel was passed Wednesday.

    The new rules, which won't come into effect until at least the fall, include a fine of up to $500 as the province joins other jurisdictions in cracking down on drivers using the devices.

    "What we're trying to do is to avoid distractions while people are driving -- those distractions being caused, in this case, by electronic devices that are hand-held," said Transportation Minister Jim Bradley, adding he has no plans to ban eating or drinking coffee in cars.

    The law doesn't affect the use of hands-free devices such as Bluetooths or using cellphones for 911 calls, but it does ban portable video games, MP3 players and DVD players.

    Global positioning systems will be allowed, as long as they're properly secured to the dashboard.

    There are no demerit points attached to the bill, but drivers who place others at risk by using one of the banned devices can also be charged under existing careless driving laws.

    The law exempts firefighters, police and paramedics, but several other groups have also asked for a pass.

    The Transportation Ministry is considering additional exemptions for devices used to dispatch, track and monitor commercial drivers, but said more changes are unlikely.

    "There are organizations that have come forward to say (they) believe they should have an exemption," Bradley said. "We'll have to evaluate that very carefully.

    "We will be extremely reluctant as a government to grant any exemptions unless a very compelling case could be made for that."

    Bradley wouldn't give a specific date for the ban to take effect, noting it still needs to go through certain legislative processes and an education period so the public learns the rules.

    But he said drivers can expect the change to come "later this year, possibly in the fall."

    NDP Leader Andrea Horwath said she supported the bill, noting if people must communicate while driving, there are hands-free gadgets that allow them to do so.

    "Technology exists that can prevent people from having to use a hand-held device, and I think that's where the biggest concern is in terms of distraction," she said.

    Ontario is the fourth province to enact such a ban, following Newfoundland and Labrador, Quebec and Nova Scotia.

    In Newfoundland and Labrador, which in 2003 became the first province to ban the use of hand-held cellphones, the penalties range from $11 to $400 plus four demerit points.

    Quebec motorists face fines of $115 plus the loss of three demerit points, while Nova Scotia's fines start at $164.50 for a first offence and grow to $337 for subsequent offences.

    In the first year after Nova Scotia made it illegal for drivers to use hand-held cellphones, close to 2,000 tickets were handed out by police.

    In Quebec, the latest statistics show at least 12,000 tickets have been handed out by Montreal and provincial police since last July. Hand-held devices were banned on April 1, 2008, but Quebec drivers were given a three-month grace period.

    Manitoba introduced legislation in November that proposed fines of at least $190 for using hand-held cellphones or for smoking while there are children in a vehicle, while Prince Edward Island is also considering a ban.

    it's good and bad, but if kids wanna watch a movie in the back seat I don't see it a problem, it sould only be for the driver, not passangers or anything like that. IF they are banning mp3s, dvds ... what's next GPS since everyone has them. Its only dumbasses that text on the 401 and jump lanes that should get nailed. Most of us do use Bluetooth or do the mature thing and pull over. But honestly... just to be a dick... it's not rocket since to have 100% focus on the road and talk on a phone.... I'll stop here hahaha but if you struggle don't do it it's not worth it.

    +1 smoking with kids in the car... not cool, as a fine they should be kicked in privates and slapped in the face with a $1000 fine.... smarten up it's your own damn kids! (and I'm a smoker and would never think twice to smoking with kids in the car... just foolish)

    i like the law. Too many dumbasses on cell phones. Funny, everyotme I see someone drive like a moron, sure enough they're on their phone.

    Ironically though, this ONE time, a ridilcously aggressive driver who was tailgating me (and i stayed in my gear to piss him off as I was already doing the limit) he switched lanes, and that was the ONE time, I had just picked up a call and didn't have my bluetooth headset on lol. I looked like the dick hahaa.

    By the way, one thing though regarding GPS, do they mean we HAVE to secure it to the DASH and can't suction cup it to the windshield????? If so, BLAH on that part...

    i agree its about time they implement this law!!
    oh and they are also passing legislation to prevent anyone under 21 to have ZERO blood alcohol while driving, but are allowing teenagers to carry passengers. IMHO i think every drier should have zero blood alcohol while driving... it shouldn't be limited to ppl who are under 21

    you could always argue about this. Kinda similar to aftermarket HIDs and real projector lights

    They should also pass the winter tires in the winter law.

    As i have read the descriptions, it means the GPS has to be mounted, as in not in your hands.

    I doubt they are really going to knock you if it's mounted to your windshield. I'm not sure but I thought mounting things to your windshield is currently illegal.

    Its all about having ammo to use against you if they want.

    Drivers who place others at risk as a result of using a hands-free device can be charged with Careless Driving and face fines of up to $1,000, six demerit points , driver’s licence suspension and possible jailtime.
    Drivers convicted of Dangerous Driving (a criminal offence), could face a penalty of up to $2,000 and five years in jail.

    I think the gps mounted on the dash is distracting. I keep mine beside me. once I set the address I don't need to see it as it talks to me and tells me turn right on Derry road in 500 meters etc .

    Like ron popeil says.... just set it and forget it. lol

    I disagree with you. I could have one glass of wine and a couple of hours later I can guarentee that I would drive just as well as if I didn't have one. just my opionion

    True, it's sad but DUI's happens with all ages, you can ran stats but seriously.... no matter what age/where you live it happens. But passing a zero blood level on all drivers good luck... . Some people do not feel the way alcohol hits, others do. Some people I'm sure could drink 6+ and drive home fine (no I'm not promoting this at all ) . The main problem is drinking and driving or death from Drunk drivers has gone up and this is one of the options to try and see if it solves it. Only time will tell.

    for laws like this, it depends on the cop.
    i used to have underglow on ALL the time at night, and never got pulled over.
    it all depends on how strict they are in your town, and how much of a dick they are.

    and this law is going to get me in LOTS of trouble.
    i text and drive ALL the time.

    It is nice and all to have this law but the big question is how enforceable will it be? Seriously when was the last time anyone saw a patrol car on the road? Their presence is next to none. Like the drunk driver notification line, will they set up a dedicated section for distracted....correction...handheld device users? This law really is toothless. It would have been better to social engineer the populace to shame this kind of behavior, like the drinking & driving. ooooo wait! Perhaps better driver training with regular refresher classes would do.

    what about the police officers who drive around on their cellphones. ive seen it and so have you all. what if we see a cop doing it. can we pull him over and make him give himself a 500$ ticket.. dont think so.

    uh, that's like saying you can give a cop a speeding ticket...

    The police are always exempt even if they are breaking the law (in most cases).

    but see thats BS. So your telling me a cop can do everything because he is the law YET WE CANT. that is completely stupid. I believe that if we see a police officer doing something we cannot do, we should have the right to make a citizen citation. im not saying all cops do it but i have seen it alot. "here is a ticket for doing something i did 10 minutes ago but its okay because I AM THE LAW. no thats not right.

    Kind of wish we could though. Watched one cruiser in the area lurk near an intersection to nab people who don't come to complete stops at the 4-way. He got someone who didn't see him and I was driving the opposite way down the street. In a residential area with a school just down the road and 40kmph zone all, this cop, with full lights a blazin', passed me doing about 90kmph and still accelerating to catch-up to the car he nailed. For what? Catching the hardened criminal who didn't wait 3 seconds at the stop sign when there was no other traffic?? The cop should have had his license taken away and is in serious need of a perspective check.

    Oh I agree with you 100%, but that's not how it is unfortunately. Yes they can be punished for their illegal actions, but in most cases it will go on without consequence.
