I was caught last week on 401 near Windsor. The OPP pulled me over for "Failing to move into another lane when approaching stopped emergency vehicle – if safe to do" (Highway Traffic Act 159.1(2)). I wasn't aware of this traffic act until then.

This is a 3 points, $490 ticket! I can't afford to go to court by myself since it'll cost me more than $490 (2 days off and gas). I can't mail to set a trial date, I've to go to the court to set one up.

I need to find a reliable and good traffic ticket fighter to fight it over! Please advise.

I'd suggest Points but they cost just as much as your ticket (less the demerit points) I think.

It was worth it for me when I got hit with Careless driving (6 points, $600)

159.1 (1) Upon approaching an emergency vehicle with its lamp producing intermittent flashes of red light that is stopped on a highway, the driver of a vehicle travelling on the same side of the highway shall slow down and proceed with caution, having due regard for traffic on and the conditions of the highway and the weather, to ensure that the driver does not collide with the emergency vehicle or endanger any person outside of the emergency vehicle. 2002, c. 21, s. 1.

Same

(2) Upon approaching an emergency vehicle with its lamp producing intermittent flashes of red light that is stopped on a highway with two or more lanes of traffic on the same side of the highway as the side on which the emergency vehicle is stopped, the driver of a vehicle travelling in the same lane that the emergency vehicle is stopped in or in a lane that is adjacent to the emergency vehicle, in addition to slowing down and proceeding with caution as required by subsection (1), shall move into another lane if the movement can be made in safety.

don't know any ticket fighters but you could try to prove that it wasn't safe for you to move into the other lane so you proceeded to follow subsection (1) - i.e. if there was traffic in the other lane also slowing down, blocking you from making a safe lane change; instead, you went as far left in the right lane as possible and slowed down, ensuring the officer's safety as you passed.

March 31 eh? looks like the cop was trying to make his quote at month-end.

That's a tough ticket to get IMO. How fast were you going (honestly) when you passed the cop?

There was a SUV on the other lane, thought it was not side-by-side with me, but one or two meters ahead. I think that's the strongest point for me.

That's exactly what I think.

I'm pretty sure I was doing under 100 what I passed the cop, or I was going at the same speed as the traffic. The cop wasn't clocking me when I passed.

X-Copper has managed to completely eliminate every ticket I've hired them to fight so far.

Points fought my careless driving charge when I rear ended a car on an ice covered road 3 years ago. They got it dropped to 2 points and failing to turn left to avoid a collision. (which was still stupid, cuz if I turned left I would have died in a head on) But bottom line is Points got the job done for about $650.

u didnt win, u just didnt lose that badly.

doesnt seem like points really did get the job done lol.

@autoexe: i hear xcopper over charges. however if they beat every single one of ur tickets, then it seems like its worth it to me. if u dont mind me asking, whats under ur belt? (in terms of tickets)

I was referred to X-Copper by my friend. They quoted me $400, win or lose. I've to talk to them again and ensure that they've very very high success rate on that type of ticket.

I asked my insurance company after it all happened what my rates would have increased to if the charge stuck. So, I consider it a win due to the fact I am saving about $3000 per year over 6 years ($18,000 total) in increased rates from a 6 demerit point careless driving to a 2 point minor infraction.

shami the OP hasn't logged on since March 2012. Not likely that he will respond.

Go to court and hope the officer doesn't show. Or plead for lesser charge for first time offense.
