Friend over on another forum recently emailed the York Region Police about the supposed crackdown on Mod'd cars and got the following reply from Sgt. David Mitchell:



Hi Richard,


I am aware of some of the discussion on the internet regarding modified vehicles?and some of the information posted by unknown people is completely in-accurate.

Cars are not being towed at an alarming rate. Cars that are being towed off the roadway have some sort of safety violation, the plates are removed and the drivers charged with the operation of an unsafe vehicle.

Police officers that are come into contact with modified vehicles or a vehicle were the mechanical fitness is in question?..will sometimes issue a report to inspection station notice. This requires the driver to show up with the vehicle at an inspection station at a later date to have the vehicle inspected by a vehicle mechanical expert.

(Ministry of Transport vehicle Inspector, licenced mechanic etc..) Vehicles will be subject to the same mechanical fitness examination. If you are buying or selling a used car, the vehicle requires a safety standards certificate before the vehicle can be re-registered. You can take your vehicle to a licenced mechanic and have it inspected?however this certificate is only valid for one month and does not exempt the vehicle from being stopped and inspected.


The following is a guide that officers use for examining the mechanical fitness of a vehicle.

The vehicle will be out of service if the following defect(s) contravene Ontario Regulation 611 schedule 1 of the Highway Traffic Act.



Chassis
-frame, underbody and body mounts should be inspected

-no chassis frame member or structural member of a unitized body shall be visibly cracked, perforated by corrosion, or have loose or missing connecting fasteners that may degrade the safety of the vehicle or jeopardize its handling characteristics and

-the underbody, excluding the underbody of a separate cargo body, shall no be visibly perforated by rust or otherwise damaged, or have any opening other than those intended by the manufacturer.

Exhaust System
-the exhaust system including exhaust manifolds should be inspected

-no exhaust pipe, muffler or tail pipe shall be missing, or insecurely mounted

-no leakage shall be present at any point in the exhaust system, except through moisture drain holes provided by the manufacturer

-no component thereof shall be so located as to cause charring or other heat damage to any wiring, fuel line, brake line or combustible material of the vehicle

-no component thereof shall pass through the occupant compartment

-no component thereof shall be so located or unguarded that an individual may be burned thereby on entering or leaving the vehicle

-and no exhaust system shall be shortened or modified for original equipment so as to fail to direct the exhaust beyond the underbody or the occupant compartment or luggage compartment, and in no case shall the distance between the outlet and periphery of the underbody, past which it directs the exhaust, exceed 15 centimetres

-any exhaust system leaks and underbody rust if perforated into the passenger compartment.

Note: Most common modification is the installation of aftermarket muffler.

-if installed and making an excessive or unusual noise. Inspect muffler common for

some after market mufflers to be straight with no apparent baffles to reduce noise.


Highway Traffic Act 75(1) Muffler-Every motor vehicle or motor assisted bicycle shall be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and excessive smoke, and no person shall us a muffler cut-out, straight exhaust, gutted muffler, Hollywood muffler, by-pass or similar device upon a motor vehicle or motor assisted bicycle.



Fuel System
-no mounting or attachment shall be missing or insecure

-no filler cap shall be missing or insecure and no leakage shall be present at any point in the fuel system





Braking System
-fluid level of master cylinder

-parking brakes do not hold vehicle stationary

-brake flex hoses cracked and exposing the inner core

-leaks anywhere in braking system



Suspension
-components as strut suspension should be inspected for wear and damage.

-on lowered vehicles, inspect how vehicle lowered. Professional lowering kits are

okay when installed properly. Cutting sections out of springs to lower vehicle is improper. Other suspension components are not designed to compensate and may cause adverse effect of vehicle handling.

-front and rear springs, shackles, U-bolts, centre bolts, radius rods, control arms, shock absorbers, equalizers, stabilizers, their supports and attachments thereto should be inspected and none shall be loose, bent, cracked, broken, disconnected, perforated by corrosion or missing.



TIRES
Section 70(3) Highway Traffic Act


No person shall operate or permit to be operated upon a highway a vehicle that is,

a) fitted with a tire that does not conform with the standards and specifications prescribed in the regulations; or

b) fitted with tires that are installed in a manner, in a place or in a combination that does not conform with the specifications prescribed in the regulations.

Referring to O.Reg. 625.



-tires and rims should be inspected

-tires worn to below 1.5 millimeters in two adjacent major grooves or tread wear indicators contact the roadway. Any exposed cord or bulges (any dangerous condition)

-check tire sidewall if allowed for street use. (racing slicks will normally say not for street use on sidewall)

Note: Tires and rims are the most common after market upgrade for most street racers. Most common problem is the actual tire is worn out from repeated use or hard driving. Inspect tread for depth. Easiest way to check on a street legal tire is to find the tread wear indicators. If they are in contact with the roadway the tire is improper for highway use.

excellent info!

but you can still see that there is leeway written into most of the laws, i guess it can depend ont he cops personaility and tempermant also!

If I read between the lines, it sounds like if the cop doesn't like your car, he can order you to have it inspected. Probably at your time and expense as well.

While it was good of that cop to respond, it sounds fairly arbitrary.

Not as arbitrary as them impounding your car for "suspected" streetracing. :flaming

turbo/supercharger? - You'll most likely be dropped from your insurave company anyway, at which point you shouldn't even be on the road.

Assuming you still have insurance, i would think that as long it conforms to emission laws, you'll be fine. (i could be wrong though)

but the better answer is because now you have in writing something that a cop told you.

i heard the VW club got hit in woodbridge recently and this is a month long crackdown

one of the VWs was pretty much stock
