nice find but if you look at other cars in the the same size class as the 3, ie, lancer, focus, a3, 3 series, s40 theyre all about the same. the only thing giving the higher end cars a fair or a good rating is the side curtain air bags. given that they would have tested the 3 using the side curtains it probably would have faired just as well as the s40 in its rating.

They also don't take into account the 07's side airbags, i wonder if it would fare better than "poor" on a 07.

Unfortunately, I don't think side-airbags would prevent the test-car from coming that far into the cab in a side-impact. Very scary! Skull fracture and damage to internal organs.
