On my way into work today going to get onto the 400 and I get rear ended on the on ramp and end up going into the car ahead of me. Now, from what I understand, I'm most likely going to be 50/50 with regards to rear ending the one in the front and not at fault for being rear ended, is that right? If any members in insurance can chime in on this and let me know if that's correct and what affects it'll have on my premium? Do I have to pay for repairs too?:flaming
That sucks so much! Are you okay though? How bad is the damage?
How did the accident happen exactly? It's important to know when determining who's at fault. Were you making a lane change? was he? etc.
Usually if you get rear ended, it's the other person's fault because of so many possible reasons like: he was following too close, made a dangerous lane change, etc etc

Well, we were getting on the on ramp, it started to back up so the person in front braked, I did as well and both came to a stop. The girl behind me rear ends me and pushes me into the lady ahead. Everyone is okay, both my front and rear bumpers probably need replacing:flaming So mad, this is the second time I've been rear ended in like the last 3-5months, I'm so vexed! Thanks for the concern fini.

If you've left enough stopping distance between yourself and the car in front of you then you cannot be held responsible from someone pushing you into them. The person behind you is at fault.
With respect to the repairs you will have to pay the deductible but the rest will be covered by the insurance company. As for the effects on your insurance rates that would depend on your driving history.

The cops didn't come out to see it, I think I left enough room, would it then be based on each parties word?

Basically yes. But what you have going for you is that the person behind you hit you first. The insurance company will look at what initiated the accident and then access whether or not it was possible you could have done something to minimize it. Do you have an estimate on the cost of the damage?
Sorry to hear about your car.
If the cops were called and all cars a re still drivable and the damage is only the bumper cover which is what it sounds like, you were too close.
Sounds like a 50/50 to me.

You are 0% at-fault - provided the insurance company believes your story. You really should get a police report.
(4) If only automobile "C" is in motion when the incident occurs,
(a) in the collision between automobiles "A" and "B", neither driver is at fault for the incident; and
(b) in the collision between automobiles "B" and "C", the driver of automobile "B" is not at fault and the driver of automobile "C" is 100 per cent at fault for the incident.

this happened to a friend of mine and yonge and bloor (man did it much up traffic)
she was rear ended by someone and it pushed her into the car in front of her. she was not at fault.

Thanks for the info guys, that's what I was thinking. In terms of repairs, the covers definitely need to be replaced on the front and back, but I think my rear absorber might need replacing as well, as the cover is sticking out on the sides and the impact felt quite hard. We'll see, gotta go see an adjuster later, as well as visit the reporting centre.

I was always under the impression that the person that initiated it was responsible for all damage, including knocking you into the person ahead of you.

Ya Skarbro.. that was quite the nice hook up!! As long as your car was not in motion when it happened your not at fault... How come the police were not called if you don't mind me asking... or did you call them and they said not to worry about it..?? As for the Reporting center.. make sure you do that... you have 24 hours to report an accident otherwise you can be charged for leaving the scene of an accident... glad to hear you are okay.. thats all that really matters and im sorry abotu the poor car!

Thanks WLS ZMZM, I did call the police but because there was no injuries to report and all the cars were driveable, they didn't bother dispatching anyone. 24hrs to report? I was told 72hrs by the police, nonetheless I am going today to do so today. Any idea if the 05?!? bumper with the cut out for the trunk fits an 04?

The key is that you have to have stopped before you got hit from behind. If you were in motion, then it becomes 50/50. That's the key. If you stopped before hitting the guy in front of you... and then the guy behind hit you, then make damn sure all the reports are very clear on that when you fill them out.

Many, many, MANY times I have been parked in a lot and I am backing out of the parking space. Beside me is a large SUV or van, and I can't see through it (I'm not Superman). So I back out slowly to give other cars a chance to see me. And what do they do? Stop because they see me backing out? Honk to let me know they are coming? No, they ACCELERATE and swerve to get past me and I cannot even count the number of times where a collision has been avoided by just inches because I was paying attention and saw them at the last fraction of a second.
According to the rules that would be MY fault? That really burns me up.

Thanks for all the sympathy everyone, the situation is more an annoyance than anything. Did the reporting centre deal and made it quite clear in the report that I had come to a stop at the time of impact as advised. Now it's the waiting game and to see how the three insurance companies sort this out, hopefully in my favour. Went to get an estimate today, 2500 for both bumpers and my grill (not the one for my teeth:chuckle). I requested the 05 rear bumper with the cut out so that it's easier to get to the trunk, I figured might as well make some lemonade:)

Off topic.
Are you sure the 05 rear bumper has a cut out for your hand? I have a 05 and no cut out, only the hatch does that I`m aware of. I know 07 sedans now have the cut out.

The rear bumper cover is the same 04-06. It only added the hand cut out in 07. Moving to the '07 bumper is expensive, as you have to change the shock absorber and brace as well. Joe looked into it for me, a little while back when I replaced my rear bumper cover.

Ami, I have to replace everything anyways so is the 07 bumper an option then in terms of fit?
