View Full Version : First time dealing with the court system

The story begins when im going to meet a friend on January 16, 2008. im driving down steeles passing over islington ave. and theres a car that is going slower than the speed limit (i didn't have my 3 at this time) and i pass the car not knowing that it is picking up speed at a rapid rate. As i pass under the bridge there is someone coming onto the street and signaling me to pull over. im like oh snap! a officer with a radar gun booked me doing 110 km/h in a 60 zone! the officer approaches the vehicle and shows me the gun and it says 110 km/h which means i was doing 50 km/h over the limit which is automatic license suspension and car impoundment. he tells me he's not gonna suspend my license nor impound my car but he did give me a court summons which i had no clue what it meant. So the next month i go in for my court summons and they just gave me a date which is Dec 16, 2008 which is 10 months after i was booked speeding. so i go in on Dec 16 and the prosecutor tells me that they can drop it to 40km/h over and i pay a fine of $280+court fees and 4 points. I face the judge and he drops my fine to $200 and no points im like good and i have 90 days to pay it.

WORD TO ALL YOU SPEEDERS OUT THERE..LET THIS BE A WARNING TO YOU!!! DO NOT SPEED THE MINIMUM FINE FOR 50 OVER IS $526. and i also found out that for every km/h over the speed limit you are fined $7 and after 50 over it is $9.75. just so you know

Careless on its own is a $325 (plus tax) charge and 6 points. Icky.

Fight the careless. It's no fun paying insurance for a careless. The amount that I'm paying right now, I could be leasing a fully loaded c230. Luckily it's been dropping but still enough to have fully paid off half my car.

What was the careless for? I got careless when I was 17(I think)( fell asleep at the wheel and rolled the car)

I used Points and they got it knocked down to Driving In an Unmarked lane and no points, aswell as the fine cut in half.

Mind you I had to pay a lot to points, but I got to keep my license and never had to plead a case as to why I should be able to keep it(which is required once you reach 6 points on a G2)

That is my trial date. I never had to be summoned. It was my choice to fight it or not.

I rear ended a woman with kids in the car. So yeah it sucked. I'm taking one of those paralegals to court too so I'm hoping I will get some mercy. I'm also a brand new G2 driver so it hurts bad. Jan 21 is when it all goes down.

I mean really...if you're going to 'rear end' a woman, you really should make sure her kids aren't in the car and are at least tucked away safely in bed. I mean, the kids don't need to see all that at such an impressionable age...

Angela, I know the whole experience hasn't been an awesome one for you. Just trying, albeit badly... to use some perverse 'guy' humour to make you chuckle a little. At the end of the day, despite the nasty hit to your wallet, your car looks awesome again now, nobody was hurt from the accident and I'm confident they'll take the situation into perspective and lower the charges for you. It could have been much worse...

Things will work out and you know we'll be thinking of you. The charge of careless is a little severe for something like this...

the only time i've been to court was for a parking ticket...but i did get pulled over for aggressive driving but i was let off with a warning, (the aggressive driving wasn't for speeding, it was for crossing two lanes in one motion)

no problem Phil....i gotta stop doing that when i enter the hwy, usually i enter the hwy faster then most people in the slow lane and just enter in one of the passing lanes...

yea you talked about that maybe what 3 weeks ago or something. i do that all the time.. i probably should be more careful in how i drive. hmmm

I'm revamping this thread since my ticket went to court yesterday.

For those of you who don't know I rear ended a woman which resulted in a three car collision which I was at fault for. I also got slapped with a careless driving charge.

A careless charge is a $325 fine and six demerit points. This really hurts me as a G2 driver as you have to face license review at 6 demerit points at G2 status. And I need my license due to my profession.

So I hired a traffic court paralegal to take my ticket to court for me. He assured me upon hire I would no longer have a careless charge on my record.

So after everything was said and done my new charge is "failing to merge into the left lane to avoid a collision" and it's a 2 demerit point offence and a $110 fine which I have 90 days to pay.

I think this is a pretty darn good deal and I'm happy with the results. Better than having careless on my record for sure.

The car is pretty again and my mind is at ease.

Thanks Phil! I know I'm pretty lucky!! Not as sweet of a deal as you got but I could have been taken to the cleaners on this as I was five days into my license when I got this!

Whatever that man said worked. Yay for everything.

This obviously doesn't include the Fee the paralegal will charge you. Glad to hear things worked out for you and that is was worth it in the end.

well I had to prepay his fee otherwise he wouldn't have worked on my case/ appeared for me yesterday. That was a cool 450 dollars.

But in the end it's worth it. I may be paying $560 instead of $325 but the insurance savings and the lesser demerit points will make my life a hell of a lot easier in the long run.

grrr. i went to points too. they dropped it from a 35 to a 29. one point and 77$ OOOOH i still got 3 points on my g-2 licence bah

I don't think it will. Just show remorse and prove to them how awesome of a cop you really can be.

Plus if you're good for the next year that will be brownie points since you can argue it was before you got into police school etc.

You lucky SOB. I got nabbed for going 50 over (which I know I wasn't) because I avoided having an accident on a single lane highway when an asshat just pulled off the shoulder with no indication or nothing and my choices were to either rear-end him or hit the gas and do a safe pass (a blind hill was coming up). I was speeding when the cop clocked me but I wasn't going 50 over (more like 30). Anyways the cop right away told me she was impounding my car which she did and took my license away for 7 days. The best part was I was out of town visiting the wife's family so my car was now impounded 4 hours away from home and we had to take a bus back home. So far I've had 4 meetings with the Crown, which has been a total waste of time, and they don't want to offer a resolution and want to see me get the full charges of Stunt Driving so my day in front of the judge is next month. What really pisses me off is the cop wouldn't show me the radar gun (which she doesn't have to but I think with serious charges like this they should) and she lied several times on the Police report but there's nothing I can do about it as it's her word vs mine.

you should ask whether she had any training with the gun and whether the gun was calibrated properly or if she was wearing a hat when she pulled you over..

Zero.

You get demerit points for various infractions. Once they are on your record they stay there for three years. When you accumluate enough points they pull you in for an interview. And if you get enough more after that they suspend your licence.

The definition of "enough" depends on what licence you have.

I got booked 36 over and I hired a lawyer. I didnt go to court but he worked his magic and had the ticket thrown out. Phew. I know how you feel. Big relief!!

i heard that speeding tickets stay on your record for 3 yrs and accidents stay on record for 6 yrs. (insurance company records)

From your insurance companies perspective... it's a ticket. Get a couple and your insurance rates go up. A couple more and they cancel your insurance.

so when you get your first ticket the rates go up when you renew it or will the insurance excuse the first ticket depending on the level of the charge?
