View Full Version : Ontario ban on handheld devices while driving..its about time !!!

Get your hands off those cellphones, Ontario drivers -- a new law that bans using hand-held devices to talk, email, or send text messages while behind the wheel was passed Wednesday.
The new rules, which won't come into effect until at least the fall, include a fine of up to $500 as the province joins other jurisdictions in cracking down on drivers using the devices.
"What we're trying to do is to avoid distractions while people are driving -- those distractions being caused, in this case, by electronic devices that are hand-held," said Transportation Minister Jim Bradley, adding he has no plans to ban eating or drinking coffee in cars.
The law doesn't affect the use of hands-free devices such as Bluetooths or using cellphones for 911 calls, but it does ban portable video games, MP3 players and DVD players.
Global positioning systems will be allowed, as long as they're properly secured to the dashboard.
There are no demerit points attached to the bill, but drivers who place others at risk by using one of the banned devices can also be charged under existing careless driving laws.
The law exempts firefighters, police and paramedics, but several other groups have also asked for a pass.
The Transportation Ministry is considering additional exemptions for devices used to dispatch, track and monitor commercial drivers, but said more changes are unlikely.
"There are organizations that have come forward to say (they) believe they should have an exemption," Bradley said. "We'll have to evaluate that very carefully.
"We will be extremely reluctant as a government to grant any exemptions unless a very compelling case could be made for that."
Bradley wouldn't give a specific date for the ban to take effect, noting it still needs to go through certain legislative processes and an education period so the public learns the rules.
But he said drivers can expect the change to come "later this year, possibly in the fall."
NDP Leader Andrea Horwath said she supported the bill, noting if people must communicate while driving, there are hands-free gadgets that allow them to do so.
"Technology exists that can prevent people from having to use a hand-held device, and I think that's where the biggest concern is in terms of distraction," she said.
Ontario is the fourth province to enact such a ban, following Newfoundland and Labrador, Quebec and Nova Scotia.
In Newfoundland and Labrador, which in 2003 became the first province to ban the use of hand-held cellphones, the penalties range from $11 to $400 plus four demerit points.
Quebec motorists face fines of $115 plus the loss of three demerit points, while Nova Scotia's fines start at $164.50 for a first offence and grow to $337 for subsequent offences.
In the first year after Nova Scotia made it illegal for drivers to use hand-held cellphones, close to 2,000 tickets were handed out by police.
In Quebec, the latest statistics show at least 12,000 tickets have been handed out by Montreal and provincial police since last July. Hand-held devices were banned on April 1, 2008, but Quebec drivers were given a three-month grace period.
Manitoba introduced legislation in November that proposed fines of at least $190 for using hand-held cellphones or for smoking while there are children in a vehicle, while Prince Edward Island is also considering a ban.

it's good and bad, but if kids wanna watch a movie in the back seat I don't see it a problem, it sould only be for the driver, not passangers or anything like that. IF they are banning mp3s, dvds ... what's next GPS since everyone has them. Its only dumbasses that text on the 401 and jump lanes that should get nailed. Most of us do use Bluetooth or do the mature thing and pull over. But honestly... just to be a dick... it's not rocket since to have 100% focus on the road and talk on a phone.... I'll stop here hahaha but if you struggle don't do it it's not worth it.
+1 smoking with kids in the car... not cool, as a fine they should be kicked in privates and slapped in the face with a $1000 fine.... smarten up it's your own damn kids! (and I'm a smoker and would never think twice to smoking with kids in the car... just foolish)

i like the law. Too many dumbasses on cell phones. Funny, everyotme I see someone drive like a moron, sure enough they're on their phone.
Ironically though, this ONE time, a ridilcously aggressive driver who was tailgating me (and i stayed in my gear to piss him off as I was already doing the limit) he switched lanes, and that was the ONE time, I had just picked up a call and didn't have my bluetooth headset on lol. I looked like the dick hahaa.
By the way, one thing though regarding GPS, do they mean we HAVE to secure it to the DASH and can't suction cup it to the windshield????? If so, BLAH on that part...:complain

you could always argue about this. Kinda similar to aftermarket HIDs and real projector lights
They should also pass the winter tires in the winter law.

As i have read the descriptions, it means the GPS has to be mounted, as in not in your hands.
I doubt they are really going to knock you if it's mounted to your windshield. I'm not sure but I thought mounting things to your windshield is currently illegal.
Its all about having ammo to use against you if they want.

Drivers convicted of Dangerous Driving (a criminal offence), could face a penalty of up to $2,000 and five years in jail.

I think the gps mounted on the dash is distracting. I keep mine beside me. once I set the address I don't need to see it as it talks to me and tells me turn right on Derry road in 500 meters etc .

I disagree with you. I could have one glass of wine and a couple of hours later I can guarentee that I would drive just as well as if I didn't have one. just my opionion

True, it's sad but DUI's happens with all ages, you can ran stats but seriously.... no matter what age/where you live it happens. But passing a zero blood level on all drivers good luck...:loco . Some people do not feel the way alcohol hits, others do. Some people I'm sure could drink 6+ and drive home fine (no I'm not promoting this at all ) . The main problem is drinking and driving or death from Drunk drivers has gone up and this is one of the options to try and see if it solves it. Only time will tell.

Anyone can confirm this? I always mount my GPS on the windshield left bottom corner.

for laws like this, it depends on the cop.
i used to have underglow on ALL the time at night, and never got pulled over.
it all depends on how strict they are in your town, and how much of a dick they are.
and this law is going to get me in LOTS of trouble.
i text and drive ALL the time.

It is nice and all to have this law but the big question is how enforceable will it be? Seriously when was the last time anyone saw a patrol car on the road? Their presence is next to none. Like the drunk driver notification line, will they set up a dedicated section for distracted....correction...handheld device users? This law really is toothless. It would have been better to social engineer the populace to shame this kind of behavior, like the drinking & driving. ooooo wait! Perhaps better driver training with regular refresher classes would do.

Kind of wish we could though. Watched one cruiser in the area lurk near an intersection to nab people who don't come to complete stops at the 4-way. He got someone who didn't see him and I was driving the opposite way down the street. In a residential area with a school just down the road and 40kmph zone all, this cop, with full lights a blazin', passed me doing about 90kmph and still accelerating to catch-up to the car he nailed. For what? Catching the hardened criminal who didn't wait 3 seconds at the stop sign when there was no other traffic?? The cop should have had his license taken away and is in serious need of a perspective check.

this is my plan. any police officer i see doing this i will follow him and flag him down take his badge number and car number and get this settled. i dont care. It to me is BS if i can get a fine for this but the people who are supposed to uphold the law are breaking the law. nah. they are citizens like me its not a badge do to whatever you want with. :bang:complain but then again with my record they wont believe a "punk 19 year old in a mazda3", but it shouldnt matter. Okay, I have to say, one of the things that annoy me are people don't "Keep right except to pass"
I signal left, and if they don't notice, fog lights on and off. And if they still don't notice, high beams on and off. Still no luck, I pass them, on the right, which is illegal. It seems like 95% of the time, they're on their cell phone. :bang

what? cops get penalized too and also serve jail time for their offence. If a cop is caught smoking marijuana they will be suspended without pay and have to go through a disciplinary hearing which is not a good thing. As for the cell phones i see alottttt of cops driving with the phone to their ears and they will get the same punishment even though they are the law so there is no difference

They may be on police business - correct me if I'm wrong, but cellphone signal transmissions are encrypted vs. using radio, which isn't.

why pull them over..if they pull you over and you seen them talking on the fone you can tell them that they were on a cell phone while driving..then what are they gonna say "So im a police officer i do what i want" BS. if they give you a ticket take it to court and tell the judge its not a fair trial because the officer that pulled you over was also breaking the law by talking on a cell phone. Charges will be dropped and your free to go.

That's a blanket statement don't you think? I'm pretty sure cops get away with things but then again so do you and I everyday of our lives when we drive. Does that mean we should get pulled over for every traffic infraction?
How many people knowingly break the law and then go to court to plead down the case to something less severe? I think it works both ways jamie. I like the law for the most part. Enforcement is going to be an issue though.

True enough however, the police officer that had given me a ticket for going 85 in a 50 lives by me so i know what he drives (ironically its a 04 3 GT) and he passed a bunch of cars in front of me WHILE TALKING ON HIS CELLPHONE. meh i dunno doesnt add up for me. but i guess what goes around comes around. Im not saying that police get away with everything but they get away with alot. This law police will break just like nothing mattered. Thats my only point. If a police officer is talking on the cellphone and sees someone else driving by him talking on the cellphone pulls him over and gives him a 500$ ticket... is that not hypocritical?

I'm doing 65 in a 60 zone... on YONGE STREET. Its packed. I'm not slowing traffic. I ended up passing the dude anyway, as the "passing lane" on YONGE STREET was just as packed.

Did anyone actually read the whole first post before they started bashing the police?
And on that subject, yes, they do stupid things sometimes just like anyone else. But if it came down to it, any one of those brave men and women would put their life on the line to save yours. Police are very under appreciated and very underpaid for all the crap they do and have to put up with for trying to keep our communities safe. Could anyone imagine how much murder, mugging, thefts there would be with no police force at all?
People mainly don't like cops because they give them speeding tickets, etc. But really, they are just doing their job. Do you know any other profession where they are hated just by doing their job? No one is going to walk up to my dad at work and yell at him for being a mainframe programmer. People don't walk up to me on the street and yell at me cause I work construction.
I have witnessed the hypocritical actions of police before. If anyone has ever seen my vacation picture thread, last year in Nova Scotia I got nailed at 155 in an 80 zone. The RCMP who got me was my grandmother's neighbour. Well, about a month and a half after that he was going about 140km/h in the SAME area he caught me, but he was in his Harley. He tried passing a car over a double yellow line while going around a corner. He ran out of road and hit the guard rail and fell 200ft down the mountain. And you know what? If I saw him do that, I'd still do everything in my power to help him out because I know he'd do the same for me. In the end he was alive but in a full body cast. People don't realize the good police do in the community and only see/remember the bad side. This is a very one sided view which I think is completely wrong to have. I know there are a couple officers and/or officers to be in this forum. I really appreciate all the hard work and dedication to the community's safety that every officer of the law provides.

And on that subject, yes, they do stupid things sometimes just like anyone else. But if it came down to it, any one of those brave men and women would put their life on the line to save yours. Police are very under appreciated and very underpaid for all the crap they do and have to put up with for trying to keep our communities safe. Could anyone imagine how much murder, mugging, thefts there would be with no police force at all?

I have witnessed the hypocritical actions of police before. If anyone has ever seen my vacation picture thread, last year in Nova Scotia I got nailed at 155 in an 80 zone. The RCMP who got me was my grandmother's neighbour. Well, about a month and a half after that he was going about 140km/h in the SAME area he caught me, but he was in his Harley. He tried passing a car over a double yellow line while going around a corner. He ran out of road and hit the guard rail and fell 200ft down the mountain. And you know what? If I saw him do that, I'd still do everything in my power to help him out because I know he'd do the same for me. In the end he was alive but in a full body cast. You’re correct that individuals don't become cops to save the day or to make a difference. Policing/Corrections/Customs etc, is a job. Through bashing their mental and physical testing is however funny to me. Considering your profession more than likely lacks this. Policing is one of the hardiest professions to get into, and being a complete “dumbass” will NOT get your hired. Police testing is a long process and has many aspects. I've gone through it so I know it's not a joke. Next time do your research before you trash peoples careers and occupations :AH considering they are over 20 members on here trying to pursue this career or are currently employed in legal fields related! What are you talking about??? If it wasn't for police..how would the law be enforced? How would people know that they are safe in dangerous areas? There are some cops that are a holes and some cops that actually care for the community. Get your facts straight. just because you hate cops doesn't mean that everyone else does too. i personally have nothing against cops and i follow the rules of the road. Although there are those who are reckless and don't deserve a license to drive. it is the cops responsibility to get those drivers off the road so that no accidents are caused. any how this thread is about handheld's and driving not bashing cops.

My future profession probably does lack the physical test however I know most of the people I know became cops out of last resort. It's a good paying job which anyone can do as long as you are somewhat fit. That doesn't mean that you aren't intelligent -- I'm just saying you don't need to be smart guy to become a cop.
So no, it doesn't require a lot of intelligence -- And the physical stress tests of a firefighter far exceed that of a cop's. What is the minimum to get in on a beep test? 5.5? ...
And it is exactly this, why cops become a corrupt with power -- because they need more education and less "I'm a cop and your a mere peasant" attitude.
Anyways, I was just replying to the guy on WHY cops are hated. I'm not even going to mention that there are exceptions to every rule and to stop acting like I speak for everyone -- It's a stupid retort.

It is so impossible to put cops on every corner and street. It is all about human Psychology. If every driver would think that there is a chance of a stealth cops driving around, then it is a deterrent for speeding.

Two hands on a steering wheel, is total BS. All cars are autos and have powersteering, so there is no troule to avaoid accidents if one will occure. I can steering freely with my index finger and my thumb.
Hands free dvices, are no better then hand held, because you still MENTALY destracted.
This law is just another pathetic cash grab for the goverment, same as 50 over. And what "street racers" do you on those lots: dump truck, fire fighter cars, unmarked police cars, minivans, grandmas caddies and oldmobiles...

My point is, and should of said in my post that doing 85 in a 50 might be more serious than doing 50 and over in a 100 zone. A 50 posted are usually in areas for a reason like school zones, heavy foot traffic, parks, etc. Would you want to walk down a street with your parents, brother or sister or your son or daughter and some noob drives buy doing 85 in a 50 or how about 100 in a 50.
No comment on your porn comment you made...have to agree towing the car is not needed, but I think its there to scare us even more not to speed over 50. If they tow your car there is always transit or a cab that can take you to work etc...

today I saw the stupidest thing. I was walking to work and I saw this Saab driven my a women talking on the phone. She was making a left turn off a side street (she was facing south) on to Queen. As she slowly crept out she blocked the street car moving east. She kept looking left and right moving out only so much as to prevent the cars behind her from making a right hand turn. She must have had ample opportunities to make the turn, but she was too busy talking. It was a sight you had to witness at how someone could literally block an intersection. Cars were honking, TTC was horning, but wait.. she couldn't hang up for that moment. It was truly idiotic. I ended up walking down queen and a min later I see her zipping by still on the phone.

And who says that the Judge is not bias towards majoraty of people who think just like you. Let me repeat myeself, banning the HAND held devices won't do much. Problem is in your brain, when your brain is occupied that's when there is a problem. But the law doesn't say anything about wirless or handless technology, you will still be able to talk.
You probably one of those people who think goverment is REAAAALLY looking after your wellbing. Banning on hand guns to lower gun confrontations on the streets. 99% of guns on the street in crminals and gangs hands are not legal, so how is the banning proper legal ownage of guns will help. Especially here in the city, where we get actuall snow on the roads for like 10 days through out the winter, other days it's all melted. Snow tires don't make sense.

Unfortunately its something people will have to get used to.. i know my girlfriend called me while she was driving... and she is scary enough driving without distractions. but still we all do it one time or another. its going to be one of those laws that are hard to enforce.

Okay..maybe YOU can drive with one finger, maybe WE can drive with one finger. Maybe even the majority of the people (for example) that can drive with one finger? (I doubt that the majority can but lets say so for arguments sake).
Now what about that 10% (its probably MORE) that CAN'T drive with one finger?
Face it, the majority of drivers suck. Hence, they need less distractions, and the more hands on the wheel, the better. I DO NOT disagree with you on the "mental distractions" research and I agree with it. Right now however, there's a mental AND physical distraction.
The winter tire agreement goes back to the same idea; drivers suck. You get the line of cars in for repair after a collision..but can you tell me you know with absolute certainty that the line would NOT be bigger if there were no winter tires?
Wasn't trying to be attacking, I'm just trying to make a point. In my opinion, any less distraction is a good thing. Unfortunately everyone today seems to think driving is a right; and its starting to show on the road.

I too agree with the mental distraction being a bigger problem. You should hear me on the phone when i'm driving (on bluetooth). I go incoherent because I can't concentrate on both driving and talking intelligently but i know what to prioritize. Like they teach to pilots "Aviate, Navigate, Communicate". In that order.
I've also seen what happens when someone is holding on to the phone while talking and trying to signal/shift a manual. It's both hilarious and scary at the same time when they get all confused, having 3 things to do and only 2 hands to do it. (Hint: they never just drop the phone)

I did not say anything about conspiracy. You jumping to extreme by saying that the government does NOTHING for your well being, of coarse it does but at 5% of what it can actually do. Governments always used “cookie and a whip” technique.(it’s a saying in Russian) They “beat” you up with a “whip” (new taxes, fees…) and then they give you a “cookie” to sweeten your anger buy saying that they care and protect you (50 over, hand gun ban…).

To enforce something on the public means you have to make a law/rules. Without those, you can't enforce anything.
How are you going to 'enforce' what you've said? Through some notion that people will, out of some 'greater good' just stop using them because they've been taught to not do it?
Human nature (IMHO) is they take/do what they can get away with if there is no punishment/cost. Putting into law that you have to be educated and trained not to use hand held devices/wireless devices on it's own will not provide motive to the public at large to not use them. It is with a law, like this one, which provides a means of punishment and enforcement that people become more motivated to at least think about it a bit more and just maybe not use a handheld device.
Your statement is not far fetched though - with this law along with education that it's just not good to do any non-driving tasks, while driving, it is more likely that people will 'buy in' to the law.
Just my $0.02 in a handsfree world...

Uhhh anyone who doesn't speed cuz of the fear of an undercover cop probably won't speed at all. If you ask any problem speeder they will tell you that they look out for under covers and cop cars. I can tell an under cover a mile off. The people who get caught by undercover are usually innocent drivers who went 15-20 over because they were late for work or something. Why do you think some municipalities are putting up cop car cut outs ? Because a cop car automaticLly stops alll speeders.

Unfortunately its something people will have to get used to.. i know my girlfriend called me while she was driving... and she is scary enough driving without distractions. but still we all do it one time or another. its going to be one of those laws that are hard to enforce.
first off I don't have a phone
so I don't dial and drive or even text at the same time.
My MP3 is plugged in and it runs on its own, no fast forwarding etc so no playing with it...
question, how important was your gf call, if cell phones weren't available or invented yet what would she do?

yeah. Hands free is just a conspiracy from the telecom giants to force us all to buy new phones and headsets. Winter tires is just a conspiracy from the rubber-industrial-complex to make us think it's safer. Same for airbags. And seat belts. And that whole cooking your food thing? That's from the energy companies trying to rip us off.

Okay..maybe YOU can drive with one finger, maybe WE can drive with one finger. Maybe even the majority of the people (for example) that can drive with one finger? (I doubt that the majority can but lets say so for arguments sake).
Now what about that 10% (its probably MORE) that CAN'T drive with one finger?
Face it, the majority of drivers suck. Hence, they need less distractions, and the more hands on the wheel, the better. I DO NOT disagree with you on the "mental distractions" research and I agree with it. Right now however, there's a mental AND physical distraction.
The winter tire agreement goes back to the same idea; drivers suck. You get the line of cars in for repair after a collision..but can you tell me you know with absolute certainty that the line would NOT be bigger if there were no winter tires?
Wasn't trying to be attacking, I'm just trying to make a point. In my opinion, any less distraction is a good thing. Unfortunately everyone today seems to think driving is a right; and its starting to show on the road.

I was going to respond to N's post with "I can usually smell BS a mile away, but my BS detector's been in the shop for the last week.", but then I'd be probably considered 'rude'.
Perhaps spotting an under cover cop car has something to do with the gravitional pull of the sun and using a hand held device while driving.

It's a figure of speech --
But telling a cop car and an undercover from the same distance... is pretty easy.
First off underCovers are BLACK or WHITE Ford Vicorias, Dodge Chargers and Cheverlet Impalas.
The writing on the side of the car becomes visible at a certain angle and will say POLICE.
There will be more than 1 antenna coming out of the back.
The rims are always going to be black or steelies.
There will be a cage behind the driver, sometimes, but there will be a barrier from the driver and the rear passenger.
In any case, when I look out for a cop I'm always weary of a black or white Impala, Charger, Victoria in the same way I'm weary of a car that has the sirens up top (which sometimes end up being security).
I've only got 3 tickets total .. and I've been driving for 8 years, and I'm always speeding. Before the over 50 rule, I'd be going 160 - 220 on the 407. I've never crashed my car into another car either. I also use my cell phone when I drive. After the over 50 rule, I go 140-145 on all highways. I also weave in and out of traffic -- I enjoy driving :)

so far you have been lucky not crashing into someone and killing someone innocent and your passenger or someone not innocent like you.
To spot the cars you described you need to be close to them which if you are speeding will be to late for you to slow down. So where does the "mile away" play into the skill to spot them...duh...:loco:bang
I hear the 407 will try and reduce speeders by introducing speed timers. When you enter the highway at a certain time they know how long it takes where you exit. If you speed the travel time will be shorter so expect a speeding ticket everyday....LOL :chuckle YA BABY YA

Well in Toronto and in OPP land, you might want to look out for the gold coloured Tahoes, or the silver Montana's... or even Toronto's Porche.
Police services now-a-days will use what ever they can. My brother-in-law is OPP and they used to use a rusted out Grand Am for traffic in the Parry Sound district.
I pride myself on being a skilled driver, but that doesn't make me good. I talk / text all the time... And what I have found, when something starts to happen that requires immediate attention, I throw my phone on the passenger seat and grab the wheel like I should, and I am sure you all do the same. It's like turning down the music when you’re looking for a house number... You need to reduce distraction from your other senses so you can focus on the important one at the time.
I recently had a conversation with a blind man at my work. My colleague asked him if it's true that your other senses are enlightened because you’re blind. After making fun of her for the fact he wouldn't know because he could never see, so how would he know the difference, he made a good point. You are always paying attention to everything going on. You always smell things in the air, hear stuff going on, see things 180 degrees around you, and feel things around you and so on. When you start to focus on one thing (cell phones), you start to neglect your other senses. The more you focus, the less other things you notice. Does not matter how good you are... your human and you will get distracted when focusing on your phone. :bang
What I fear about this new law though, is how people will try to hide the fact that they are texting. I normally see people with their phones up by the steering wheel or in front of them while texting... This way, their prefrial vision can catch things up ahead. However now, they are going to hold the phone in their laps, or to their sides, causing them to focus their vision in a way that they cannot see what’s going on in front of them. :loco
As for enforcement... piece of cake. Most cell phone users are in a trance when driving. They don't look around, or watch their mirrors. A fully marked cruiser can easily creep up behind them or beside them and be unnoticed. :blush
And as for cops breaking the law by talking on their phones while driving... I believe it said clearly in the bill that police, fire, ems, and dispatchers are exempt from the law... so Jaime, no pulling over a cop cause he is on the phone... he's allowed by law ;)

what I still don't get is what is so important that we need to use a phone etc 24/7 ....you all heard this before, what did we do before cell phones, how did we get by? can't we wait till we get off the road, parked or home or at our destination? I would guess 90% of calls are just of no importance, just "like to say hi or what are you doing tonight?" :bang

If you read the whole thing it specifically states only handheld devices and TV's in particular in the driver's view are illegal.Most oem built in units are still legal.As would be GPS units or aftermarket screens with GPS etc.

GPSs itself is fine.
The operation of a GPS when driving the car, is that legal or illegal? I read the pdf, but it doesn't seem to mention it; it does mention the operation of an entertainment device is illegal unless you are legally parked and not in motion.
