in 2009 i was 18 when i bought my first car, Mazda 3 hatchback 05 GS. used at 94,000 km
exactly one year later driving home from work the alarm randomly went off, when i opened my door the entire cab was filled with black smoke the dashboard mainly the center radio/AC was crumbling in front my eyes , when i called fire dpt. they soaked the insides and extinguished everything. my insurance company did not cover anything, they are asking for money to close the account, because im financing the car i put fire and theft on my policy, im still paying for the car. what can i do?

insurance company says i did not add fire and theft which i was told had to be on my policy if i was financing..

It's about settling/closing the insurance claim; and how he can get out of paying for a car that's obviously not in his possession anymore.

i wish i had friends or family to help . no one told me the right way to go about this.
im looking for smart ppl who understand not everyone has things handed to them ..
i lost my job, my girl of 7 years and now im kicked out of my house.. cuz im such a newbie, i wish someone could take me under their wing and show me the ropes .. i just signed up 2 so idk anything about computers. ive been working everyday to pay the lawyer now, waiting for pat foran to get my info from lawyers.. http://s1156.photobucket.com/albums/p571/sonic_apex/

something is missing from this story. There is nothing but the radio and heater climate control in the center dash. I have NEVER seen a radio or climate control unit mysteriously catch fire. The alarm system is controlled through the PJB unless the smoke was comming from there and it seemed like from the radio area.
Leased and financed vehicles are "SUPPOSED" to have full coverage. If you say the insurance said you had fire then I suggest you read through your insurance book that they send you with the insurance slips and price break down. It will describe your policy there.

You said you were driving, and when you opened the door the cabin was filled with smoke. That makes no sense.
What exactly happened.

And also, you need to look through your insurance information.

when i first bought the car i had full insurance paying $750 monthly. when i heard i could get third party coverage. with the (personal) insurance company paying $450 i paid upfront to someone and my records of the insurance company show i did not pay anything. but i paid first and last when hooked up. no receipt just a piece of paper showing date of next payments.. its seems like a scam from the insurance company. but i cant prove it.

sounds like you got scammed. Now unfortunately because you have no proof of anything I don't think a lawyer would be able to help you. They could say that the list with the payment dates could simply be a list you created. What exactly is 3rd party coverage?

Its possible the original owner had a factory alarm system installed after they bought it.

I think what happened was the OP originally had full coverage paying $750 a month, which allowed him to drive the car away after financing. Once you drive the car off the lot, the financier usually wont pull your insurance record to make sure you still have full coverage. Once the OP switched to the $450 insurance, he may not have been covered by fire/theft anymore on the new policy.

If you do not have proof that at the time of the damage your insurance policy covered fire/theft, then you are shit out of luck my friend. Its your word against theirs and they have all the power to screw up your credit rating.

I had the same area in my grand am catch fire while i was driving near Kingston. It turned out to be a short in the wiring that makes the lighter, ashtray lighting, ect ect. work. I was lucky enough to catch it in time to put it out. Unfortunately the op wasn't.

Alarm or panic going off doesn't mater and is more likely un related. The centre console has wiring and the ability to catch fire.

To the OP

it sounds like you've been scammed my friend. To me it sounds like you never had insurance after the company switch.
And please make sure to keep all paperwork for 5 years( 7 depending on the type of paperwork. )

Out of curiosity do you know how much more you owe. If it's not to much it may be better to talk to another dealer into tagging that amount onto a new car loan. That way at least you'll have a car.

If you didn't then you got screwed hard.

You need yo talk to a lawyer and take this guy who gave you "3re party" insurance to court.

Way more information needed. This story is Swiss cheese. If you would like help or advice, try not to be so vague, and unless you have a gag order, drop some names. Not having full coverage on that car was 100% your fault and I'm pretty sure that's against your agreement with your financing company. My advice is to bank some coin, by a shit box and get your life back together. Concentrate on what is important. This story has so much more in it about your life than just a problem with your car/insurance and money.

Both 2004 and 2008 brochures linked... at no time did Mazda EVER equipped the GX or GS with alarms... the older and newer brochures shows this fact, and if you want, you can spend the time googling for the other years to see for yourself

just because your remote has the red button, doesn't mean you have an alarm

you want to be really sure whether you have an alarm or not? roll the window down... lock the doors with your remote... reach inside and unlock the door manually... open it... does it start honking? no = no alarm... yes = have alarm

factory alarm wasn't optional... you either had it or you didn't
and there was no dealer install option for it except for remote start, which adds an alarm at the same time

Another thing, is get the paperwork that Mazda Canada has on the vehicle. They may not be able to help you, but they can at least provide what they know and the dealership information, and if anything get the dealership in some trouble if they scammed you
