View Full Version : exhaust ticket for modded exhaust

Hello Tm3 members,

I was on my way to get a coin-up car wash this evening. A cop beside me suddenly slow down and pull behind to pull me over. He ask me if it's an aftermarket exhaust cuz it doesn't seem like there's a exhaust baffle inside. I told him this a oem exhaust from the car and the tone is a little louder than other mazda vechicles (I don't think understand what i was telling him). He then wrote me a ticket for "unnessary noise" and said I should install a proper baffle in my exhaust.

Here's a list of what I have done on my speed

1. Cpe 3" dp
2. 2 factory resonator deleted (1 factory resonator on)

Hope everyone can give me some adivice on my scenario. Thx Guys

Cpe is not a OEM exhaust.
And deleting a resonator is definitely not going to help.

get a mechanic to write you a receipt and say you fixed it, and then show it to the prosecutor during first attendance and they will toss the ticket

Another more creative defense, get a DB meter, go to a Harley Davidson dealership, measure the DB from one of the bikes, then measure the DB from your car. Go to court and ask the prosecutor if they apply the same standard of justice for cars and bikes.

Title is misleading the content, you didn't get a ticket of your OEM MS3 Exhaust, is the combination of your DP and resonators deleted. And when you get the ticket, were you really Reviving for no reason?
If yes, then the officer is just doing his job.

U make no sense. First of all, I'm asking members for their advice. Secondly, I didn't complaint my modified exhaust. I believe cops need to fill their quota for the month. I'm just an unlucky guy with a modified Mazda to encounter him.

Please don't bs on my thread if u aren't giving me any useful advice. Respect other members. I already got a ticket and it's ticking me off. U don't need to put fuel in fire anymore.

I haven't heard how loud your exhaust is.. However if you feel that your exhaust is quieter than the standard annoying loud rice rocket exhaust or any motorcycle then I would fight it.
Loud obnoxious exhausts are disrupting to every living thing they drive past and should be punished much harsher IMO.

i also have deleted 2 resonators but i don't find the exhaust loud and unnecessary...but i still have my stock down pipe. cop must have been bored or having a bad day. YRP, toronto, peel, durham, opp?

I understand that loud exhaust is really disturbing. Personally, I think it's not even louder than Magnaflow, vibrant, etc on the market. I don't rev and drive like an asshat in a city or hwy, just some on ramp off ramp. I had a full I/h/e setup on my old 3 and honestly the sound was crazy compare to the speed with my current setup.

It happened in Hamilton downtown. I live nearly 5 mins by Hess village. I should have taken a different route on a Saturday night to bypass those drinkers and cops next time.

+1 ...I've done the same for my 95 Escort when all i had was a resonator(no muffler ;p)

Fight it. Go to your mechanic, get him to "check it out" and either issue you a receipt for checking everything saying it's stock, or that it's fixed. It's BS because its really not that loud with the resonators out + dp. I wouldn't say its quieter than magnaflow though.

Anyway, even if you don't want to go that route and want to go a more ethical route, just make a court date and they will either drop it after asking you if its fixed (to which you'll respond that it's the stock catback .. wouldn't expect the judge to know to ask about the downpipe) or just ask for a reduction. You will 100% walk out with at least 50% of the fine dropped.

No, worst advice would be to tell him to track down the cop and shoot him.

If you have time to waste in court over $110 then that's fine, however a lot of people will lose a lot more for taking the day off or part of the day, or even worse using your limited vacation days to go to court for a stupid ticket.

Jimmy is my car mechanic who does all the work on it. I might have to pay him a visit and see what he can do for me. I just hate cops wasting their time for catching innocent citizens. I'm just car enthusias and definitely not like I'm doing stupid burn outs or reving at the light. I drove normal as others on the road, respect others as they have family an friends who love them. What ticks me off is not the ticket or money, I was just out of my apartment in 5 minutes and he targeted me right away! I guess the government just needs more fundings for constructions city an hwy.

U definitely got the point! I wouldnt mine paying for just $110. But if I do, the cop would use the same method to target others. I'm still on my probation on my new job. I don't wanna get fire for absence, late an other stuff. I wouldnt mind paying a paralegal to appeal if I can get a mechanic letter to the court. A man with a badge doesn't mean he can charge people with these nonsense charges. They r here to serve and protect, not target and nonsense.

I live close to a harley dealer, and i can definatey say no speed3 is gonna make anywhere close to the noise that some of those things make..

They really need to trash the "officers discretion" crap.

Hopefully you get this resolved, such a b/s ticket.

It really isnt that.

It is up to the officer, that is the problem.

Not everyone likes "loud" cars, and this officer didnt, so at HIS DISCRETION, the exhaust was too loud.

If they personally think its too loud, thats all there is to it unfortunately.

Pretty sketchy way to enforce the HTA huh?

There are 2, what I assume are Harleys, but by the way my neighbors attend to it, it may be custom. They are extremely loud. Like 10pm at night, they leave their engines running for a bit on the drive way before they head out, and you can hear it from my living room (to the back of my house) while we're watching TV. If I'm on the driveway I can barely talk to someone 5 feet from me. It doesn't really bother me, but if they can have a bike like that, there is no way any car is making that noise.

I think the cops might wanna avoid encountering a Harley becuz they don't wanna deal with the Hells Angels (never know who's riding). They rather take their time to stop by Timmies to kill some time.

I doubt that's the reasoning. There's definitely a double standard. I've seen harley's pulled over, most likely for speeding. I always hear Harley's go by near cops and they don't pull them over for the noise.

I never seen just one Harley on the road but they're a bunch whenever they pass by. I doubt if u actually seen them getting pull over ( usually 6-10 Harleys speeding at once ). At least, I think they might need three or four cop cars to stop some of them

Haven't actually seen them getting pulled over, just see them on the side of the road. It's usually just 1-2 harleys on the side.

We have approxitimately10-15 Harley's gathering at the timmies in Hamilton downtown from fri-sat. No one would get close to that specific timmies when they're partying.

In Ontario cops don't carry DB meters that I've ever seen and I've got a couple exhaust tickets. It's based on their judgement. My buddy got an exhaust ticket for improper muffler on his bone stock is300.

The ticket is benign and has no bearing on insurance, aside from wasting your own time and money. If you decide to fight it its pretty easy to contest.

And your title is misleading. Your exhaust maybe Oem, but there are modifications to it, such as the removal of the resonator.

There is no way that you know whether someone on a Harley is in the hellz angels, you just assume it because everyone part of the harley biker scene looks identical. Leather jackets, beards, tattoos, sunglasses and long hair.

The point is, your exhaust is NOT stock. Your car IS louder. So ultimately, the cop was right. Whether it's fair because there are 2641786t41782647821 other cars and bikes on the road louder than yours shouldn't be an argument because we have no way of testing whether that exact cop would have pulled over a Harley or a ricer civic if they had been where you were at the time. Point is you were doing something illegal. The good news is you have options which you should most definitely capitalize on.

Just because you have some pieces of an OEM exhaust left doesn't make your exhaust OEM.

Well for starters you aren't innocent, so there's no problem there. You do not have an OEM exhaust system, you removed resonators and installed a downpipe. How can you sit there and say you're the victim? You've clearly modified your car in a way that violates the MTO Code / HTA.
